Club terms
In short.
- Whoever creates or claims a club accepts these terms for the club.
- The club owns the sessions recorded into it and decides who sees them and how long they are kept. The club is the controller of that data; we process it for the club.
- Coaching sessions may be relayed live to the club's coaches. The club tells its members so.
- A claim by an official makes the club verified. Duplicates merge. Idle clubs go dormant, not deleted.
1. Who agrees to what
These terms are between Jon Davies, trading as Renegade Dynamics ("we"), and the club. A club is represented in the app by its administrators. The person who creates a club, and each person who claims it or is made an administrator, confirms that they may accept these terms for the club and accepts them on its behalf. If the club is an unincorporated association, its committee or officers are bound in the usual way; if it is a company, charity or school, that body is.
The app terms and the privacy policy apply alongside these. Where they conflict for something a club does, these terms win.
2. The administrator's responsibilities
An administrator:
- approves and removes members and sets their roles, and keeps that list to people who belong to the club;
- sets the club's retention period and can delete sessions;
- keeps the roster accurate, including which members are juniors;
- makes sure the club's members have been told what the app records and that coaching sessions may be relayed live (section 4);
- answers a member's question about their own data in the club, and passes to us any request the member makes of us;
- does not use the club's data for anything outside coaching, training and running the club;
- tells us at once if a device or account with club access is lost or compromised.
A club should have at least two administrators so that one leaving does not lock the club.
3. Members and juniors
- A member holds their own account under the app terms, and must be at least 13.
- A junior may be put on the roster without an account so that a crew can be named. The roster record is the club's data and holds a name and a seat. The club is responsible for having the authority, from the junior's parent or guardian or its own membership terms, to keep that record.
- A school or junior club should read the children section of the privacy policy before signing up and should not create accounts for members under 13.
4. The audio notice
Coaching sessions recorded with this club may be relayed live, including any audio the cox switches on, to the club's coaches while the session is in progress. The audio is not stored by Renegade Dynamics, unless the person recording chooses at the start to keep it for seven days so the crew and coaches can review the outing, after which it is deleted. The recording on the recording phone belongs to the person who recorded it.
The club shows this notice to each member on joining, which the app does for it, and includes it in its own membership information where members join outside the app. A member who does not want to be recorded can ask the cox to leave the mic off; the mic switch is the opt-out.
5. The club's data and retention
- Sessions recorded into the club, the roster, squads, courses and display sets are the club's records.
- The administrator sets a retention period for sessions; the default is twelve months. Sessions older than the period are deleted. An administrator can delete a session sooner.
- A member who leaves or deletes their account is removed from the crew and coach lists of the club's sessions; the sessions stay. Motion data without a name does not identify anyone.
- The club can export any of its sessions as RGIF files at any time and on any tier. If the club leaves the service, it can export everything first, and we delete the club's data within 30 days of the request.
6. Processing on the club's behalf
For the roster and the sessions the club records, the club is the controller under UK data protection law and we are its processor. As processor we:
- process that data only to provide the service and on the club's documented instructions, which are the settings the club makes in the app and these terms;
- keep it confidential, and hold everyone with access to it to the same;
- apply the security measures in the privacy policy;
- use only the sub-processors listed in the privacy policy, tell the club before adding one, and let the club object;
- help the club answer a member's request to see, correct or delete their data, and help with any assessment or breach notification the club must make;
- tell the club without undue delay if we become aware of a breach affecting its data;
- delete or return the club's data when the club ends the agreement, subject to the retention of records the law requires;
- make available what the club needs to check that we do all of this.
For members' accounts, telemetry and the live relay we remain the controller, as the privacy policy says.
7. Creation, claim, merge and dormancy
- Creation. Anyone with an account can create a club. It starts unverified, and its creator is its administrator.
- Claim. An official of the real club can claim it with evidence: an email address at the club's domain, a federation club code, or a manual check by us. A successful claim makes the club verified and the claimant an administrator. We may remove administrator rights from someone who created a club they do not represent once an official has claimed it.
- Merge. Where the same club exists twice, we merge the duplicate into the verified one. Members, sessions, squads and courses of the duplicate move across; the duplicate's identifier keeps resolving to the merged club.
- Dormancy. A club with no sessions and no sign-ins for 180 days is marked dormant and drops out of search until touched. Nothing is deleted by dormancy.
- Removal. We may remove a club that misrepresents a real organisation, is used against the app terms, or that its own officials ask us to remove. We give the administrators notice and time to export where we can.
8. The Club subscription
- The Club tier is bought for a verified club, £199 a year, invoiced to the club and billed through Stripe. It renews yearly unless cancelled before the renewal date.
- It covers live watching and streaming for every coach and boat in that club, the roster and squads, and the monthly report allowance on the pricing page. It does not cover a coach's other clubs.
- If we withdraw something the club has paid for, we refund the unused part. [TODO: whether the Club tier is sold to consumers or only to organisations; the cancellation wording in the app terms §8 follows]
9. Safety
The safety statement in the app terms applies to the club and to every session it runs: the app is not a safety or navigation device, a live view is not a lookout, and the club, the coach and the crew remain responsible for safety on the water.
10. Leaving and ending
- A club can end this agreement at any time by asking us to delete the club, from an administrator's account. We confirm with the other administrators, then delete within 30 days.
- We can end it on 30 days' notice, or at once if the club seriously breaks these terms, and we refund the unused part of any subscription in the first case.
- Sections 5, 6 and 11 survive the end of the agreement for as long as they need to.
11. General
- We may change these terms on 30 days' notice to the club's administrators. A change to section 6 that reduces our obligations needs the club's agreement.
- The liability section of the app terms applies between us and the club, with the club's paid amounts in the previous twelve months as the cap where the club has paid us.
- The law of England and Wales governs; the courts of England and Wales have jurisdiction, except that a club elsewhere in the United Kingdom may bring a claim where it is based.
