App terms
In short.
- The app is not a safety or navigation device. Look where you are going.
- You must be at least 13. Recording is free and needs no account.
- Your recordings are yours. The raw file is free to export, for ever.
- Subscriptions are billed by Apple or Google and cancelled there. A club subscription is billed by us through Stripe.
- We do not exclude liability where the law says we cannot.
1. Who we are and what this covers
The app and the service are provided by Jon Davies, trading as Renegade Dynamics, a sole trader in the United Kingdom ("we", "us"). Address for service: Flat 3 Doyle House, 46 Trinity Church Road, London, SW13 8ED. Email: support@renegadedynamics.co.uk.
These terms are the agreement between you and us for the app, the web version and the relay service (together, "the service"). By installing the app, creating an account or using the service you accept them. If you use the service on behalf of a club, the club terms also apply to the club. Our privacy policy explains what we do with personal data and is part of this agreement.
2. Safety
The app is not a safety or navigation device. It does not replace a lookout, a cox's judgement, a coach's judgement, or the rules of the water you are on. Do not watch the screen when you should be watching the river. The crew, the cox, the coach and the club remain responsible for safety on the water at all times.
The numbers the app shows are measurements and estimates from a phone's sensors and, where used, from ours. They can be wrong, late or missing. Position from GPS can be tens of metres out. A live view can stop without warning when the phone loses signal. Do not rely on the app to know where a boat is.
A report or analysis the app produces is information for a coach to weigh, not an instruction to a rower. Any change to training or technique is the coach's and the athlete's decision.
3. Accounts and age
- You can record and analyse an outing without an account. An account is needed to store outings in the cloud, to join a club, to watch or stream live, and to subscribe.
- You must be at least 13 years old to create an account. If you are under 18, you should have the permission of a parent or guardian and, where you use it through a club, the club's knowledge.
- You sign in with Apple, Google or an email code. Keep the account you sign in with secure; what is done through your account is treated as done by you.
- Give us accurate details and keep them current. One person, one account.
4. Using the app
We give you a personal, non-exclusive, non-transferable licence to install and use the app on devices you own or control, and to use the web version, for your own rowing, coaching or club, in line with these terms. The licence lasts as long as this agreement. Where you got the app from the App Store or Google Play, that store's usage rules also apply, and Apple or Google is not a party to this agreement and has no obligation to you under it.
Some features use your phone's location, microphone, motion sensors or Bluetooth. The app asks for each permission the first time that feature is used and works without the ones you decline, apart from the feature that needs them.
5. Your content and the data promise
- Your recordings are yours. You own the sessions you record and anything you add to them. We claim no rights in them beyond what we need to provide the service.
- The raw file is free, for ever. Every session is written in RGIF, a public, documented format. You can export the file from the app on every tier, including the free one, and we will not put that behind a paywall. The full statement is at the data promise.
- What you allow us to do. By storing a session in your account or a club, you allow us to store, copy, transmit and process it to provide the service to you and to the people you or your club share it with, and to use it as described in the privacy policy.
- Sessions in a club. A session recorded into a club is a club record. The club's administrators decide who in the club may see it and how long it is kept. If you leave the club or delete your account, the club keeps the session with your name removed.
- Your responsibility. You must have the right to record and upload what you record. That includes telling the people in the boat when the mic is on.
6. Audio
Audio is recorded only while the mic switch is on, with a visible indicator, and it is saved on the recording phone. During a live session the audio is relayed to the coaches watching and is not stored by us, unless the recorder chooses at the start to keep it for seven days for the crew and coaches to review the outing, after which it is deleted. The recorder is responsible for making sure the crew know the mic is on. Details are in the privacy policy and in Recording with a cox.
7. Clubs
- Anyone with an account can create a club. An official of a real club can claim it with evidence, after which it shows a verified mark and the claimant becomes an administrator.
- A club administrator accepts the club terms on the club's behalf. They set the club's retention period, approve members, assign roles and can delete the club's sessions.
- We may merge a duplicate club into the verified one, mark a club dormant after 180 days without activity, or remove a club that misrepresents a real organisation.
8. Subscriptions
- Free. Recording, on-phone analysis, the web version for review, and export of your files. No time limit and no cap on outings.
- Live, £14.99 a year, for one account: stream your boat live and watch boats live, in both directions.
- Club, £199 a year, for one club: live watching for every coach in the club, the roster and squads, and a monthly allowance of AI outing reports. [TODO: state the number of reports a month, and confirm the report ships at launch or remove the mention]
- Prices include VAT where it applies. Prices and what each tier includes are on the pricing page; a change applies from your next renewal and we tell you before it.
- Bought in the app. Live is billed by Apple or Google to the account you bought it with. It renews each year unless you cancel at least 24 hours before the renewal date in your App Store or Google Play subscription settings. Refunds for in-app purchases are handled by the store under its rules.
- Bought on the web. Club is billed by us through Stripe to the club, yearly, and renews unless cancelled before the renewal date. As a consumer buying at a distance you can cancel within 14 days of purchase for a full refund; if you asked us to start the service in that time and used it, we may deduct a proportionate amount. [TODO: confirm whether the Club tier is sold to consumers or only to clubs as organisations; if organisations only, the 14-day right does not apply and this line changes]
- A subscription is for the account or club it was bought for. It does not transfer.
9. Pre-release software and availability
Parts of the service are new and some are marked beta. We will fix problems as we find them and we ask you to report the ones you meet through "Report a problem" in the app. We do not promise the service will be available at all times; we plan maintenance and tell you where we can, and the status page shows current availability. We may change or withdraw a feature. If we withdraw something you have paid for, we refund the unused part of the subscription.
10. What you may not do
- Use the service to break the law or someone else's rights, including recording people where they have a reasonable expectation not to be recorded.
- Access another person's account or a club's data without permission, or try to get round the entitlement checks.
- Interfere with the service, probe it for weaknesses without our written agreement, or load it in a way designed to disrupt it.
- Copy, modify, reverse-engineer or resell the app or the service, except as the law allows or as the open-source licences on parts of it allow. The RGIF format and its libraries are open, and you may use them freely under their own licences.
- Claim a club you are not entitled to claim, or misrepresent who you are.
11. Our software and marks
The app, the web version, the relay, the analysis and the designs are ours or our licensors' and stay so. "Renegade Dynamics" and the RNGD mark are our trade marks. The RGIF specification is published under CC BY 4.0 and its reference libraries under MIT or Apache-2.0; those licences, not these terms, govern their use.
12. Liability
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited or excluded under the law of England and Wales. If you are a consumer, nothing in these terms affects your rights under the Consumer Rights Act 2015, including the right to a service performed with reasonable care and skill and to digital content that is of satisfactory quality and fit for purpose.
Subject to that:
- The service is a rowing measurement and coaching tool. We are not liable for loss or damage arising from reliance on it for safety, navigation, or anything it is not designed for (section 2).
- We are not liable for loss that was not a foreseeable result of our breaking these terms, or for business losses if you are using the service as a consumer.
- For the free tier, our total liability to you is limited to £100. For a paid tier, it is limited to the amount you paid us in the twelve months before the event giving rise to the claim. [TODO: a person who is not the author to review this clause and the whole document before publication]
- You are responsible for your phone and for backing up the files on it. We keep the copies in your account with reasonable care, and the retention schedule in the privacy policy says how long deleted data can be recovered.
13. Ending the agreement
- You can end it at any time by deleting your account in the app (Account → Delete account) or by email. What is deleted and what a club keeps is set out in the privacy policy and in the help guide. Deleting the account does not cancel a store subscription: cancel that in the store.
- We can suspend or end your access if you seriously or repeatedly break these terms, if the law requires it, or if we stop providing the service, in which case we will give you at least 30 days' notice where we can and refund the unused part of any subscription bought from us.
- Sections 5, 11, 12 and 14 continue after the agreement ends.
14. General
- We may change these terms. For a change that matters to you, we will tell signed-in users in the app or by email at least 30 days before it takes effect. If you do not accept the change, end the agreement before that date.
- We may transfer this agreement to a company that takes over the business. We will tell you if we do, and your rights are unaffected.
- If any part of these terms is found invalid, the rest continues.
- These terms are governed by the law of England and Wales. If you are a consumer living elsewhere in the United Kingdom you can bring a claim in the courts where you live. The courts of England and Wales otherwise have exclusive jurisdiction.
- You can complain to us at support@renegadedynamics.co.uk; we acknowledge within 30 days. For a purchase made in the app, the store's own dispute process is also open to you.
